FACTS:
David
attended a graduation party hosted by a friend of his, William. William’s
parents, at William’s request, agreed to stay out of sight of his guests and
they were not seen all evening. They stayed in a guest cottage on the property,
watching television and drinking martinis. They were oblivious to the fact that
David was severely beaten by one of the guests, Peter, who has a vicious temper
when he has been drinking. Peter was always jealous of David and didn’t like
him at all, but Peter never had the courage to act on his resentment until the
party at William’s house. David, who was not expecting to be assaulted and who
has no self-defense skills, was badly injured. All of the attendees were under
the legal drinking age, but everyone brought the liquor that was consumed at
William’s party. How that liquor was purchased has never been disclosed.
David’s
injuries resulted in medical bills exceeding $100,000 and wants them to be paid
by William. David’s parents have filed a civil law suit against William’s
parents. You have been retained by William’s parents to defend them by
presenting a joint liability defense.
