Assignment 2: Significant Court Cases in Juvenile Justice. Starting with the Juvenile Rights Period (1960-1980), there have been many significant cases in juvenile justice involving the applicability of due process rights to juveniles. With growing unrest over the lack of due process protections for juveniles and the Supreme Courts decision in Kent v United States (1966) to grant juveniles certain due process protections in which jurisdiction is transferred from juvenile court to criminal court, the Court showed its dissatisfaction with the juvenile justice system in its current state. In the Kent decision the Court stated There is evidence
.that there may be grounds for concern that the child receives the worst of both worlds: that he gets neither the protections accorded to adults nor the solicitous care and regenerative treatment postulated for children (383 U.S. 541 (1966). Approximately one year later, the Court decided the case of in re Gault (1967), considered to be the single most important case in juvenile justice.
Instructions: For this assignment, I have provided you with 5 significant cases in juvenile justice listed below. To complete this assignment you must look up each case and provide:
The Issue (the question the Court was being asked to decide)

I have provided an example of how to complete the assignme
nt using the case of Schall v. Martin (1984) immediately below. Please make sure you follow the format I have provided. Do not cut and paste your answers. Although I realize that the Issue, Holding and Rationale are difficult to put into your own words, I do expect that the Significance of the cases are in your words.
Example:
Schall v. Martin
104 U.S. 2403 (1984)
ISSUE: Is the preventive detention of a juvenile charged with a delinquent act constitutional?
HOLDING: Yes, the Family Court Act section allowing preventive detention is valid under the due process clause of the 14th Amendment
RATIONALE: The court held that preventive detention served the legitimate state objective of protecting both the juvenile and society from the hazards of pretrial crime.
SIGNIFICANCE: The case is important because it allowed for the pretrial detention of a juvenile charged with an act of delinquency. By doing this, the court allowed states to begin implementing preventive detention in juvenile matters.
The following are the 5 cases you must address for this assignment (Make sure you do all five cases to receive full credit):
Roper v. Simmons 543 U.S. 551 (2005)
